1. Agreement to Terms

Welcome to imkitchen. These Terms of Service ("Terms") govern your access to and use of our meal planning platform, website, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use our Services.

These Terms constitute a legally binding agreement between you and imkitchen ("we," "us," or "our"). We reserve the right to update these Terms at any time. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must meet the following requirements to use our Services:

• You must be at least 13 years of age
• You must have the legal capacity to enter into a binding contract
• You must not be prohibited from using our Services under applicable laws
• You must provide accurate and complete registration information

By using our Services, you represent and warrant that you meet all eligibility requirements.

3. Account Registration and Security

3.1 Account Creation

To access certain features, you must create an account by providing accurate, current, and complete information including your name, email address, and password.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

3.3 Account Accuracy

You agree to keep your account information accurate and up to date. We reserve the right to suspend or terminate accounts with inaccurate, fraudulent, or misleading information.

3.4 One Account Per User

You may only create one account. Multiple accounts created by the same person to circumvent service limitations (e.g., free tier recipe limits) are prohibited and may result in account termination.

4. Subscription and Payment Terms

4.1 Free Tier

Our free tier includes:

• Meal plan generation for all future weeks of current month
• Maximum of 7 recipes used in meal plan generation (ordered by creation date)
• Only main courses used in meal plan generation
• Meal preferences not applied in meal plan generation
• Cannot batch import recipes
• Unlimited regenerations
• Full access to recipe management and community features

4.2 Premium Subscription

Premium subscriptions are offered at the following rates:

• Monthly: $9.99/month, auto-renews monthly
• Annual: $59.94/year ($4.99/month equivalent), auto-renews annually

Premium benefits include:

• Unlimited recipes in meal plan generation
• All recipe types in meal plan (appetizers, sides, desserts)
• Meal preferences applied in meal plan generation
• Batch recipe import
• Priority support
• Early access to new features

4.3 Billing and Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel. You authorize us to charge your payment method for renewal fees. We will notify you of upcoming charges via email.

4.4 Price Changes

We may change subscription prices with 30 days' notice. Price changes apply to new subscriptions and renewals occurring after the effective date. Current subscribers will be notified via email.

4.5 Payment Methods

We accept major credit cards processed through secure third-party payment processors. You authorize us to save your payment information for recurring billing.

4.6 Failed Payments

If a payment fails, we will attempt to charge your payment method multiple times. If payment cannot be processed, your subscription will be downgraded to the free tier.

4.7 Taxes

Prices do not include applicable taxes. You are responsible for all sales, use, and excise taxes, and any other similar taxes, duties, and charges imposed by any government entity.

5. Cancellation and Refunds

5.1 Cancellation by You

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain premium access until the end of the paid period, then automatically revert to the free tier.

5.2 No Refunds

All payments are non-refundable. We do not provide refunds or credits for partial months or unused portions of annual subscriptions. You remain responsible for all charges incurred prior to cancellation.

5.3 Exceptions

Refunds may be considered in exceptional circumstances such as billing errors or duplicate charges. Contact support within 7 days of the charge for review.

5.4 Downgrade Effects

When you downgrade to the free tier after cancellation:

• Meal plan generation limited to 7 recipes (main courses only)
• Meal preferences will not be applied in meal plan generation
• Batch recipe import will be disabled
• Previously generated meal plans remain accessible according to free tier rules

6. User Content and Recipes

6.1 Your Content

You retain all rights to recipes, meal plans, and other content you create or import ("User Content"). By using our Services, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and process your User Content solely to provide and improve our Services.

6.2 Shared Recipes

When you share recipes with the community, you grant other users the right to:

• View and favorite your shared recipes
• Include your recipes in their personal meal plans
• Rate and review your recipes

You may unshare or delete recipes at any time, but snapshots in other users' meal plans will be preserved.

6.3 Recipe Snapshots

When meal plans are generated, we create complete snapshots/copies of all referenced recipes. This ensures meal plan integrity if you or other recipe creators delete or modify recipes. You acknowledge and agree to this practice.

6.4 Content Standards

You agree that your User Content will not:

• Contain false, inaccurate, or misleading information
• Infringe on intellectual property rights of others
• Contain offensive, hateful, or discriminatory content
• Contain spam, advertising, or promotional material
• Contain malicious code, viruses, or harmful components
• Violate any applicable laws or regulations

6.5 Content Moderation

We rely on community ratings and reviews for quality control. We do not pre-approve recipes but reserve the right to remove content that violates these Terms or is flagged by users.

6.6 Imported Recipes

You represent that you have the right to import and use all recipes you upload via JSON import. You are responsible for ensuring imported content does not infringe third-party rights.

7. Acceptable Use Policy

You agree not to:

• Use the Services for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Services or servers
• Use automated tools (bots, scrapers) without written permission
• Reverse engineer, decompile, or disassemble any part of the Services
• Remove or modify any copyright, trademark, or proprietary notices
• Create multiple accounts to circumvent service limitations
• Sell, transfer, or sublicense your account to others
• Upload malicious files (viruses, malware, oversized payloads)
• Harass, abuse, or harm other users
• Impersonate any person or entity

8. Intellectual Property Rights

8.1 Our Content

The Services, including all software, algorithms, design, text, graphics, logos, and trademarks, are owned by imkitchen and protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms.

8.3 Restrictions

You may not copy, modify, distribute, sell, or lease any part of our Services without written permission.

8.4 Feedback

If you provide feedback or suggestions, you grant us an unrestricted, perpetual right to use and incorporate such feedback without compensation or attribution.

9. Account Suspension and Termination

9.1 By You

You may delete your account at any time through account settings. Deletion is permanent and cannot be reversed. All your personal data, recipes (except snapshots in other users' meal plans), and meal plans will be deleted within 30 days.

9.2 By Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Payment failures or chargebacks
• Abusive behavior toward other users or our team
• Security threats or system abuse

9.3 Effect of Suspension

When your account is suspended by an administrator:

• You cannot log in or access your meal plans
• Your shared recipes are hidden from community view
• All data is preserved for potential reactivation
• You are not entitled to a refund

9.4 Effect of Termination

Upon termination, your license to use the Services terminates immediately. Provisions regarding intellectual property, warranties, indemnification, and limitations of liability survive termination.

10. Disclaimers and Warranties

10.1 "As Is" Basis

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 No Guarantee of Accuracy

We do not guarantee the accuracy, completeness, or reliability of:

• User-submitted recipes or content
• Generated meal plans or shopping lists
• Accompaniment pairing suggestions
• Dietary restriction filtering

10.3 Dietary and Health Disclaimer

We are not responsible for dietary, nutritional, or health outcomes. Recipes and meal plans are for informational purposes only. Consult healthcare professionals for dietary advice, especially if you have allergies, medical conditions, or special dietary needs.

10.4 No Guarantee of Availability

We do not guarantee uninterrupted or error-free access to the Services. We may suspend or discontinue any part of the Services at any time without notice.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IMKITCHEN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage resulting from use of the Services
• Dietary, health, or nutritional outcomes
• User Content or actions of other users
• Unauthorized access to your account or data
• Errors, bugs, or service interruptions

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless imkitchen and its affiliates, officers, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your use of the Services
• Your User Content
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before filing a claim, you agree to contact us at support@imkitchen.app to attempt to resolve the dispute informally. We will attempt to resolve disputes within 30 days.

13.2 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

13.3 Jurisdiction

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in [Your Jurisdiction], and you consent to personal jurisdiction in such courts.

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision in the future.

14.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or internet/infrastructure failures.

14.6 Third-Party Services

Our Services may integrate with third-party services (payment processors, email providers). We are not responsible for the performance or actions of these third parties.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, legal requirements, or business practices. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last updated" date
• Sending an email notification for significant changes

Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services and may delete your account.
